1 Professional issuer of Google Voucher Card
The professional issuer of the Google Voucher Card ("Google Voucher Card") is transact Elektronische Zahlungssysteme GmbH, registered in the Commercial Register of the Register Court of Munich under HRB 114 439 ("transact").
2 General information on the validity of the GTC and possible uses of the voucher card
The provisions made in these General Terms and Conditions ("GTC") apply to the Google Voucher Card issued by transact (hereinafter: "voucher card"). In these GTC, the terms "you" or "your(s)" refer to the cardholder. "We", "us" or "our" means transact, including its affiliates and agents.
3 Conclusion of contract
3.1 Our offer to purchase a voucher card represents a non-binding offer. By submitting the purchase declaration, you are making a binding offer to purchase the voucher card.
3.2 The contract on the purchase of the voucher card is concluded by the implied declaration of acceptance of the employee of a sales outlet.
3.3 The purchase or use of the card is subject to these GTC, which constitute the contract between transact and the cardholder. The contract language is English. By purchasing or using the card, the cardholder agrees to the validity of these GTC. The GTC are available for inspection at all our participating sales outlets at any time or are made available on the current website www.appxite.com/legal/customer-terms under the button "GTC".
3.4 This Contract and GTC shall be governed by and construed in accordance with the laws of England and Wales.
4 Changes to the GTC
Changes to these GTC will be announced on the website 2 months before they come into force. The cardholder should regularly check the Website for such changes. If he/she does not notify his/her objection within 2 months after the changes have been announced on the website, the changes shall be deemed approved and shall become an effective part of the contract. Should the cardholder be significantly disadvantaged by such a change, he/she shall be entitled to terminate the contract with immediate effect. For further information, please refer to Section 9 "Validity and Termination of Contract". With regard to the amount of money on the card, these GTC shall apply exclusively. This amount belongs exclusively to the person in possession of the card.
4.1 The card is used exclusively to make the payments described in these GTC. The contract for the goods or services itself is not concluded with transact.
5 Use of the card
5.1 You can use the card at currys.gsubscriptions.com ("Webshop") . No other use of the card is possible.
5.2 You may use the Card up to the amount of its loading - up to €250 - as often as you wish for payment at the Webshop.
5.3 transact does not guarantee that payment with the card is possible at all times.
5.4 In case of defects due to a defective card, you are entitled to replacement of the card. If you think that your card is defective, you should immediately notify us in writing by email. The contact address to be used is support@appxite.com. If the defect cannot be repaired, we will issue you a new card with the credit amount corresponding to your balance.
5.5 We may reject a payment transaction initiated by a card at the Webshop under the following conditions:
5.5.1 if there are reasonable grounds to suspect that the execution would constitute a criminal act or is prohibited for reasons of money laundering law;
5.5.2 if the card is blocked or
5.5.3 if the card does not have sufficient funds (credit) to pay the requested amount.
In case of refusal, you will be informed about the non-execution of payments immediately during the payment process.
6 Total price / fees
6.1 The card is provided to you free of charge. The amount you pay will be fully credited to the card as a balance.
6.2 Payments and checks of the card balance are free of charge. There are also no other fees.
7 No right of return
You have no right to exchange the credit amount back into money.
8 Transferability
The voucher card is impersonal and transferable.
9 Validity and termination of contract
9.1 The voucher card is valid for 13 months from the date of purchase of the card, after which the card balance expires.
9.2 There shall be no right of ordinary termination. You have the right to terminate the contract with immediate effect at any time if there is an important reason that makes it unreasonable for you to continue the contractual relationship.
9.3 We are entitled to block the card or to terminate the contract with you if we suspect fraud or misuse or if there are other security concerns or if we should be legally obliged to do so.
9.4 Upon termination of the contract, we will repay any balance remaining on your card in accordance with your instructions. In the event of termination, we will immediately block the card so that further use is no longer possible.
10 Duties of care, security of the card
10.1 You are obliged to keep your card safe and to protect it from access by unauthorized third parties.
10.2 Treat your card like cash. In the event of loss, theft or misuse of the card, the card and the credit balance on it will not be replaced by transact. Its liability is limited to the amount of the credit balance on the card.
11 Disputes with the Webshop
11.1 Any disputes concerning purchase transactions made with your card shall be settled by you with the Webshop. We are the issuer of the Card as a cashless means of payment and therefore do not assume any responsibility or warranty for the goods and services.
11.2 Please note that - once you have used a card for a purchase transaction - we cannot stop the transaction in question and the payment process.
12 Liability of transact
12.1 We shall only be liable for intent and gross negligence as well as slight negligence if an obligation is breached, compliance with which is of particular importance for achieving the purpose of the contract ("essential contractual obligation"). In the event of a slightly negligent breach of material contractual obligations, our liability shall be limited to the foreseeable damage typical for the contract. Insofar as our liability is excluded, limited or restricted, this shall also apply to the personal liability of our employees, workers, staff, representatives and vicarious agents.
12.2 We shall not be liable for any damage caused by force majeure, riots, war, natural disasters or other events beyond our control.
12.3 You are obliged to notify us of any damage without delay. We are entitled to request information from you about damages that are or may be relevant against the background of the aforementioned liability regulations in order to ensure that we have the necessary information as early as possible to be able to take measures to mitigate the damage.
